GroupTripper Terms of Use

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, you may not use the Service. We may modify these Terms at any time; continued use after changes constitutes acceptance of the modified Terms.

2. Account Registration and Security

• You must provide accurate and complete information when creating an account.
• You may sign in using email/password or Google OAuth.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• Notify us immediately at support@grouptripper.app if you suspect unauthorized access.

3. Description of Service

GroupTripper provides collaborative trip planning tools, including:

• Trip creation and itinerary management
• Collaborative suggestions and voting
• Real-time chat and discussions
• File uploads and sharing
• Calendar integration and notifications
• Integration with Google Places API for location information

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

4. User Content and Conduct

4.1 Your Content

You retain ownership of all content you create or upload to the Service ("User Content"), including trip details, itineraries, suggestions, comments, photos, and files. By posting User Content, you grant us a limited, non-exclusive, royalty-free license to use, store, display, and transmit your User Content solely to provide and improve the Service.

4.2 Sharing with Trip Members

When you add members to a trip or share content within a trip, you authorize those members to view, access, and collaborate on that content. You are responsible for managing trip membership and access.

4.3 Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Upload or share content that is offensive, abusive, defamatory, or infringes on others' rights
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) without our permission
• Impersonate any person or entity
• Upload viruses, malware, or harmful code

5. Third-Party Services

The Service integrates with third-party services, including:

• Google Places API: for location search and place information
• Google OAuth: for authentication
• Base44 and Rork: for backend infrastructure

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services.

6. Privacy

Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of information as described in the Privacy Policy.

7. Intellectual Property

The Service, including its design, features, functionality, graphics, and underlying software, is owned by the developer of GroupTripper and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• The results obtained from using the Service will be accurate or reliable
• Any errors or defects will be corrected
• The Service will meet your requirements

YOU USE THE SERVICE AT YOUR OWN RISK. We are not responsible for any travel arrangements, bookings, or decisions you make based on information in the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER OF GROUPTRIPPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability to you for all claims arising from your use of the Service shall not exceed the amount you paid us (if any) in the 12 months preceding the claim, or $100, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless GroupTripper and the developer of GroupTripper from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another party

11. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause or notice, including if we believe you have violated these Terms.

You may delete your account at any time through the app settings. Upon termination, your right to use the Service immediately ceases, and we may delete your User Content in accordance with our data retention policies (see Privacy Policy, Section 6).

12. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court. You waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms with a new "Last Updated" date and, where required, by sending you an email notification. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

14. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and GroupTripper regarding the Service.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
• Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
• Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms at any time.
